Terms of Use
These are the rules for using WalkCue. The safety notice is part of them, and the privacy policy explains what happens to your data.
Contents
1. Acceptance Link to section 1. Acceptance
1.1 These Terms of Use ("Terms") form a binding agreement between you and LIKE A KING INC. They govern your access to and use of WalkCue, including the website at walkcue.com, the WalkCue phone web app, the WalkCue Android and iOS apps, the Lab, any connection to camera glasses or other wearables, the optional assistant and "brains" features, the helper setup and sharing tools, any on-device or downloadable models, and any related updates, content and support (together, the "Service").
1.2 By installing, opening or using the Service, or by tapping or saying "I agree" (or a similar confirmation) during onboarding, you agree to these Terms, including Part B (the Safety and Assistive-Use Notice), and you acknowledge Part C (the Privacy Policy). If you do not agree, do not use the Service.
1.3 Onboarding in audio. Before first use, the Service plays a short spoken safety briefing that summarizes Part B. You confirm that you heard and understood it. You can replay it at any time from Settings, and we may ask you to confirm it again after a significant update.
1.4 Helpers and representatives. A family member, friend, caregiver, teacher or orientation and mobility instructor ("Helper") may set up the Service for you, including through the "Share setup" feature. If a Helper accepts these Terms for you, the Helper confirms that they are authorized to do so, that they have explained the Safety Notice to you or made sure you heard it, and that you agree to it. A Helper who sets up the Service for someone else must not change safety settings in a way that hides hazard warnings from that person without that person's informed agreement.
1.5 Organizations. If you use the Service for a school, agency, clinic, employer, nonprofit or other organization, or you accept these Terms for one, you confirm that you have authority to bind it, and "you" includes that organization. Institutional deployments may also be covered by a separate written agreement; if so, that agreement controls where it conflicts with these Terms.
1.6 Prototype status. Until we announce general availability, the Service is a prototype offered for testing. Prototype features may change, break or be removed without notice, and some protections described here (for example, app-store billing) apply only once those features exist.
2. License to use the app Link to section 2. License to use the app
2.1 Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Service, including its on-device models, on devices you own or control, for your own personal, non-commercial use, or, for an organization with our written permission, for its internal use.
2.2 The Service is licensed, not sold. No ownership of the Service, its code, its models or its content passes to you. All rights not expressly granted are reserved by LIKE A KING.
2.3 You must not, and must not help anyone else to: (a) copy, modify, translate or create derivative works of the Service, except to the extent the law expressly allows despite this restriction; (b) reverse engineer, decompile or disassemble the Service, or extract, copy or reuse its model weights, prompts, voices, scenario library or training data; (c) rent, lease, lend, sell, sublicense, distribute or make the Service available to anyone else, except through the Share setup feature as designed; (d) remove or alter any notice, label, warning or attribution; (e) disable, bypass or weaken any safety feature (see Part B, Section B6); (f) use the Service or its outputs to build or train a competing product; or (g) access the Service by automated means except through interfaces we provide for that purpose.
2.4 Updates. We may update the Service, including its models, cues, voices and safety rules, and some updates may install automatically. Safety-related updates may be required to keep using the Service. If you turn off updates, you may miss important safety improvements.
2.5 Source code. WalkCue's source code is proprietary and is governed by the WalkCue Proprietary Source
License in the repository's LICENSE file. These Terms do not grant any right to the source code.
3. Eligibility Link to section 3. Eligibility
3.1 You must be at least 13 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who has read these Terms and agrees to them for you, and we strongly recommend that a qualified orientation and mobility instructor is involved in learning to use it.
3.2 We do not knowingly collect personal information from children under 13. Because the Service processes camera frames and voice on the device and does not upload them by default (see Part C), using the Service does not normally give us any information about you at all. If you believe a child under 13 has given us personal information, contact us and we will delete it.
3.3 You may not use the Service if you are located in a country subject to comprehensive U.S. sanctions or are on a U.S. government list of prohibited or restricted parties, or if your use would violate U.S. export controls or sanctions.
3.4 You must not use the Service while driving or operating any vehicle, machinery or watercraft. The Service is designed for a person walking.
4. Subscriptions, pricing and billing Link to section 4. Subscriptions, pricing and billing
4.1 Free safety core. Our policy is that the core safety features of WalkCue (hazard and obstacle cues, pedestrian-signal reading where supported, and the Find feature in its basic form) are free of charge. We will not put a hazard warning behind a paywall.
4.2 Paid features. We may offer optional paid features or plans ("Pro"), for example extra voices, extended memory of your items, glasses features, or priority support. Before you pay, we will show the price in U.S. dollars, what is included, the billing period, whether it renews automatically, any free trial and when it converts, and how to cancel.
4.3 App stores. If you buy through the Apple App Store or Google Play, the store processes the payment, and its terms on billing, renewal, refunds and cancellation apply. You manage or cancel those subscriptions in your store account settings.
4.4 Automatic renewal. Subscriptions renew automatically at the end of each period until you cancel. We will obtain your affirmative consent to automatic renewal before charging you, send a confirmation that explains how to cancel, and, where required (including under New York General Business Law section 527-a and the California Automatic Renewal Law), send reminders before a free trial converts or an annual plan renews. Cancelling is as easy as signing up: you can cancel online, in the app or in your store account, without calling anyone. A cancellation takes effect at the end of the current paid period unless the law or the store requires otherwise.
4.5 Refunds. Except where the law or the app store requires a refund, payments are non-refundable and we do not give refunds for partial periods. If a paid feature did not work as described, contact us and we will look at it in good faith.
4.6 Price changes. We may change prices for future periods. We will tell you in advance, and the new price applies only from your next renewal after the notice. If you do not agree, cancel before then.
4.7 Taxes. Prices may not include sales tax, VAT or similar taxes, which are added where required.
4.8 Institutional licenses. Schools, agencies, clinics, insurers and other organizations may license WalkCue under a separate written agreement, which controls pricing and billing for that organization.
5. Your content and recordings Link to section 5. Your content and recordings
5.1 What counts as your content. "Your Content" means anything you or a Helper provide to the Service: camera frames, voice commands, photos you take to teach an item ("My things"), names and labels you give, places you save, your guide's name, voice and personality settings, feedback you send, and anything you choose to share.
5.2 You own it. As between you and us, you own Your Content. You give us only the permission needed to operate the Service for you, and only for as long as needed: for example, to process a camera frame on your device so that the Service can speak a cue, or, if you choose an optional cloud feature, to pass a frame and your question to the provider you selected.
5.3 On-device by default. By default, camera frames and voice are processed on your device and discarded after processing. The Service does not record or upload video, photos, audio or location unless you choose a feature that clearly says it will. One exception applies today: in the phone web app, the Talk button uses your browser's built-in speech recognition, and some browsers (for example Chrome on Android) send that audio to the browser maker for processing. The app says so before you use Talk, and every other feature works without it. Details are in Part C.
5.4 No training on Your Content without opt-in. We do not use Your Content to train or improve our models unless you give separate, explicit, opt-in consent for a specific program (for example a research pilot), which you can withdraw at any time. Withdrawal stops future use; data already incorporated into a trained model may not be removable from that model, and the consent screen will say so before you agree.
5.5 Feedback. If you send us ideas, suggestions or bug reports, we may use them freely without obligation to you. Please do not include other people's personal information or images in feedback.
5.6 Your responsibility. You are responsible for Your Content and for having the right to provide it. Do not teach the Service items, places or labels that would reveal other people's private information.
6. Recording other people Link to section 6. Recording other people
6.1 Bystanders. The camera on your phone or glasses sees the people around you. WalkCue is built so that it does not store images of them, does not identify them, and does not perform face recognition, voice identification or any other biometric identification. It knows only that "a person" is present and roughly where.
6.2 Your obligations. When you use a camera in public or private places, you must follow the laws that apply where you are, including laws on photography and video in private spaces, in workplaces, schools, hospitals, restrooms and changing areas, courtrooms and government buildings. Do not cover or disable the recording indicator light on camera glasses.
6.3 Audio. Some states require the consent of everyone in a conversation before it is recorded, including California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania and Washington, and others have similar rules. The Service does not record conversations. If a future feature records audio, it will say so clearly, and you must obtain any consent the law requires before using it.
6.4 Biometric laws. Laws such as the Illinois Biometric Information Privacy Act, Texas's biometric identifier law and Washington's biometric law restrict collecting face geometry, voiceprints and similar data. WalkCue does not collect biometric identifiers, and you must not modify, combine or use the Service to do so.
6.5 No surveillance. You must not use the Service to watch, follow, identify or track any person, or to collect information about people without their knowledge.
7. Third-party services Link to section 7. Third-party services
7.1 The Service works with products and services we do not control, including your phone's operating system and browser, the Apple App Store and Google Play, camera glasses and their companion apps (for example Meta glasses and the Meta AI app), Bluetooth audio devices, map and location services, content delivery networks that serve model files, your browser's speech recognition, and, only if you turn them on, cloud AI providers such as OpenAI, Anthropic, xAI and Google (Gemini).
7.2 Your use of those products is governed by their own terms and privacy policies. We are not responsible for them, for their availability, or for what they do with data you send to them. When you turn on an optional cloud feature, the Service tells you which provider will receive data and what will be sent before anything is sent.
7.3 Some models used by the Service are provided by third parties under their own licenses and use policies, which pass through to you. For example, where a Gemma model is used, you agree not to use it in violation of the Gemma Prohibited Use Policy. Part D lists these components.
7.4 A third-party product failing (for example a Bluetooth connection dropping, the glasses' battery running out, or the browser ending speech recognition) can stop WalkCue from working. Part B explains what to do.
8. Acceptable use Link to section 8. Acceptable use
You must not use the Service to: (a) break any law or regulation, or help anyone else do so; (b) watch, identify, track, stalk, harass or intimidate anyone; (c) perform face recognition, biometric identification or emotion inference about other people; (d) capture images in places where people have a reasonable expectation of privacy; (e) create, upload or share child sexual abuse material (zero tolerance; we report it to the National Center for Missing & Exploited Children and law enforcement), non-consensual intimate imagery, or sexual deepfakes of real people (including content covered by the federal TAKE IT DOWN Act); (f) attempt to disable, bypass or weaken safety features, or distribute a modified build that does; (g) interfere with or disrupt the Service, its servers or networks, or probe them for vulnerabilities except under a written security-research agreement with us; (h) scrape, copy or harvest data from the Service, or reverse engineer it (see Section 2.3); (i) misrepresent the Service's capabilities to someone who relies on it, for example by telling a blind person that it can see curbs or tell them when to cross when it cannot; or (j) use the Service, or any third-party model inside it, for any purpose prohibited by that model's use policy.
We may investigate suspected violations and take any action we consider appropriate, including suspending access and cooperating with law enforcement.
9. Our intellectual property Link to section 9. Our intellectual property
9.1 The Service, including its software, cue engine, scenario library, models and model weights, training data we created, voices and presets, designs, text, sounds, the WalkCue name and logo, and all related intellectual property, is owned by LIKE A KING INC. or its licensors and is protected by copyright, trademark, trade secret and other laws.
9.2 You may not use our names, logos or trade dress without our written permission, except to refer accurately to the Service.
9.3 Copyright complaints (DMCA). If you believe content available through the Service infringes your copyright, send a notice through our contact form with: your signature (typed is fine), a description of the work, where the infringing material is, your contact details, a statement that you believe in good faith the use is not authorized, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner. We respond to valid notices and terminate repeat infringers where appropriate.
10. Disclaimers Link to section 10. Disclaimers
10.1 Read Part B. The disclaimers in Part B are part of this Section and are the most important terms in this document.
10.2 No guarantee. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIKE A KING DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR ABLE TO DETECT ANY PARTICULAR OBJECT, HAZARD OR SIGNAL.
10.3 AI output can be wrong. WalkCue uses machine-learning models. They can miss things, see things that are not there, misjudge distance and direction, misread signs, text and signals, and describe scenes incorrectly. Descriptions from the assistant and from cloud "brains" are guesses, not facts.
10.4 Not a medical device; not professional advice. WalkCue is not intended to diagnose, treat, cure, mitigate or prevent any disease or condition, and it is not a substitute for medical care, low-vision rehabilitation, or orientation and mobility training. It does not provide medical, legal or financial advice. [Counsel to confirm the FDA position: we intend WalkCue to be marketed only as a general information and convenience aid and not as a device under section 201(h) of the Federal Food, Drug, and Cosmetic Act; any claim that it replaces a cane, guide dog or mobility training, or that it prevents injury, would change that analysis and must not be made.]
10.5 Not life-safety certified. WalkCue is not certified, rated or approved for any life-safety purpose, and must not be relied on as the only means of avoiding danger.
10.6 Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. In that case, implied warranties are limited to the shortest period the law allows.
11. Limitation of liability Link to section 11. Limitation of liability
11.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIKE A KING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER THEORY, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
11.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS (US $100).
11.3 What we do not limit. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where the law so provides, liability for death or personal injury caused by our negligence, for gross negligence, willful misconduct or fraud, or your rights under consumer protection laws that cannot be waived. [Counsel to review this section with particular care: WalkCue is used by people with disabilities in situations where injury is foreseeable, and an over-broad limitation may be unenforceable or may harm the company's position.]
11.4 These limitations are an essential part of the bargain between you and us, and they apply even if a remedy fails of its essential purpose.
12. Indemnification Link to section 12. Indemnification
12.1 To the extent the law allows, you agree to defend, indemnify and hold harmless LIKE A KING and its officers, directors, employees and contractors from third-party claims, losses and reasonable costs (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) your use of the Service to capture, use or share images or information about other people in violation of law or of Section 6 or 8; (c) your modification of the Service or distribution of a modified build; or (d) your violation of any law or third-party right.
12.2 This Section does not require a user to indemnify us for injuries that the user suffers while using the Service as intended, or for our own negligence or misconduct.
12.3 We will notify you of a claim, may control its defense at our own cost, and you will cooperate reasonably. You may not settle a claim that affects us without our written consent.
13. Termination Link to section 13. Termination
13.1 You may stop using the Service at any time. Deleting the app (or clearing the web app's site data) removes the data stored on your device, including your settings, saved places and the items you taught it. If you created an account or shared anything through an optional cloud feature, you can ask us to delete that data through the contact form.
13.2 We may suspend or end your access if you breach these Terms, if required by law, if continuing would expose you, other people or us to risk, or if we discontinue the Service. Where reasonable, we will give notice and a chance to export any data we hold. If we discontinue a paid plan, we will refund the unused prepaid portion.
13.3 Sections 2.2, 2.3, 5.5, 9, 10, 11, 12, 13.3, 15, 16, 17 and 18, Part B, and any accrued payment obligations survive termination.
14. App store terms Link to section 14. App store terms
14.1 If you downloaded the Service from the Apple App Store or Google Play, these Terms are between you and LIKE A KING only, not Apple or Google. We, not the store, are responsible for the Service and its content.
14.2 Apple. If you use an iOS version: (a) your license is limited to use on Apple-branded products you own or control, as permitted by the App Store's Usage Rules; (b) Apple has no obligation to provide maintenance or support; (c) if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; (d) Apple is not responsible for addressing claims relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation; (e) Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the app infringes intellectual property rights; (f) you confirm that you are not in a country subject to a U.S. government embargo or designated as "terrorist supporting", and are not on any U.S. government list of prohibited or restricted parties; (g) you must comply with applicable third-party terms when using the app; and (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14.3 Google. If you use an Android version from Google Play, the Google Play Terms of Service also apply, and Google is not responsible for the app or its support.
15. Governing law Link to section 15. Governing law
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, including the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to Section 16, the state and federal courts in New York County, New York have exclusive jurisdiction over any dispute not subject to arbitration, and you and we consent to their jurisdiction and venue. If you live in a place whose law gives you the right to bring a consumer claim in your home courts, this Section does not take that right away.
16. Dispute resolution and arbitration Link to section 16. Dispute resolution and arbitration
16.1 Talk to us first. Before filing a claim, you and we agree to try to resolve the dispute informally for at least 60 days. Send a written notice through the contact form describing the dispute and the relief you want; we will do the same if we have a dispute with you. Many problems can be fixed quickly this way.
16.2 Binding individual arbitration. If the dispute is not resolved informally, you and LIKE A KING agree to resolve it by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except as stated in Section 16.4. The arbitrator decides all issues, including the scope and enforceability of this agreement to arbitrate, except that a court decides questions about Section 16.5 (class waiver) and Section 16.7 (mass filings). Arbitration may be held by video or in the county where you live, or another place we both agree on. For claims under $10,000 you may choose whether the arbitration is decided on documents only, by telephone or video, or in person.
16.3 Fees. We will pay the filing, administration and arbitrator fees for any arbitration you start, except where the arbitrator finds your claim frivolous or brought for an improper purpose. Each side pays its own attorneys' fees unless the law or the arbitrator awards them.
16.4 Exceptions. Either of us may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek an injunction in court to stop infringement or misuse of intellectual property or a breach of Section 2.3 or 8.
16.5 No class actions. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking it and only to the extent needed for that party's claim. If this class waiver is found unenforceable for a claim, that claim must be decided in court, not in arbitration.
16.6 Opt out. You may opt out of this Section 16 by sending us a notice through the contact form within 30 days after you first accept these Terms, stating your name and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
16.7 Mass filings. If 25 or more similar demands are filed against us by or with the help of the same law firm or organization, they will be administered in batches under the AAA's mass-arbitration procedures, and the statute of limitations is tolled for claims waiting in a batch.
16.8 Time limit. To the extent the law allows, any claim must be started within one year after it arises, or it is permanently barred.
17. State-specific and accessibility notices Link to section 17. State-specific and accessibility notices
17.1 California. Under California Civil Code section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17.2 New Jersey. Nothing in these Terms limits any right you have under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act. If a provision of these Terms is not enforceable in New Jersey, it does not apply to New Jersey residents to that extent.
17.3 Other states. Some states do not allow certain limitations of warranties or liability, or certain dispute-resolution terms. Where that is the case, those terms apply to you only as far as your state allows.
17.4 Accessibility. We aim for WCAG 2.2 Level AA across the website and app, test with VoiceOver and TalkBack, and treat accessibility problems as serious defects. Every legal document is available in an accessible format and as audio on request, and the onboarding safety briefing is spoken. Tell us through the contact form about any barrier, and we will respond.
17.5 Consumer health data. We do not intend to collect "consumer health data" as defined in Washington's My Health My Data Act or similar laws. Whether someone uses WalkCue could suggest that they have a visual disability, so we do not sell, share or use usage data to make inferences about anyone's health, and Part C describes our limits.
18. Changes and contact Link to section 18. Changes and contact
18.1 We may change these Terms. If a change is material, we will give notice before it takes effect, in the app (including in audio) and on the website, and, where we have your email, by email. Changes do not apply retroactively. If you keep using the Service after a change takes effect, you accept it; if you do not agree, stop using the Service.
18.2 These Terms, with Parts B, C and D and any terms shown at purchase, are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets, with notice to you. Neither party is liable for delays caused by events beyond reasonable control.
18.3 Contact. Use the contact form at walkcue.com, or write to LIKE A KING INC., One World Trade Center · Suite 8500 · New York, NY 10007 · United States, Attn: WalkCue.
